Polish Prosecutors Use Poland's Public Television To Promote High Profile Prosecution

Warsaw, Poland 9 May, 2007  The prosecution of a famous Polish heart specialist that started out as a high profile arrest and was criticised by the Chief Justice of Poland's Consitutional Court, continues to create controversy. Now the prosecutors are publicly criticising the Court handling the case for releasing the accused on bail.

The prosecutors submitted a charge of murder for the death of a heart transplant patient that has been previously ruled by medical investigators as medical error. They also submitted 50 charges of corruption.

What they did not submit to the court were letters of support for the doctor written by his patients. Some of the letters were from people who are helping raise funds to pay for the Doctor's defense. The prosecutors said that it was an oversight and not done on purpose.

The Court said that it does not see, based on the material provided to it by the prosecutors, evidence that a murder was committed.

The lawyer for the accused said that the prosecutors have not given the files to her for her review. They say that they are not turning them over now for the benefit of the investigation.

The failure to provide the lawyer the files is reported to be in violation of the Polish Criminal Code and a violation of the EU human rights laws.

Now the prosecutors are going public again and using the television news channels to dispute a Court decision because they do not agree with the court that the evidence does not support a murder charge.

The Minister of Health made ambivalent remarks about the release but added that the trial would reveal shocking things to the public.
