Constitutional Tribunal Rules Against Polish Government

Poland's Prime Minister Jaroslaw Kaczynski was just served a setback when the Polish Constitutional Tribunal ruled that the new election law that removed the mandates of democratically elected representatives for failing to file a financial statement on time is not in accordance with the constitution. They ruled that the punishment does not fit the crime.

Kaczynski has been in a heated battle with the President of Warsaw over her mandate to govern the City. He declared that her mandate to govern was automatically removed at the time that she failed to file her husband's financial statement on time. The battle has tied up the court systems in Poland and thrown the entire civil process in the district into confusion over the validity of any acts taken by the City since 28 December, 2006. Kaczynski has been very aggressive in this matter. Knowing that the Tribunal was to rule today, Kaczynski criticised some of their rulings.

He said that the verdicts of the Constitutional Tribunal are sometimes very surprising to him. "In general, very strange things are happening around the Tribunal". For example, Gronkiewicz-Walcz in her letter to Mazowsze Voivoda said that she knows what legal aspect the tribunal will take into consideration, while debating on the constitutionality of the law, through which she lost her mandate.
